- Agreement to Terms
By accessing and using the website nicole-nowakowski-3a92.mykajabi.com (the "Site") and engaging in pet care services with Santa Barbara Pet Sitters ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you are not authorized to use our Site or Services.
- Services Description
2.1 Pet Care Services
Santa Barbara Pet Sitters provides the following pet care services in the Santa Barbara area (including Montecito, Carpinteria, and surrounding neighborhoods):
- Dog walking and play sessions
- Pet boarding and overnight care
- Feeding, medication administration, and wellness checks
- Hotel and travel pet care
- Wedding and event pet care coordination
- Fitness and wellness services (including massage and Reiki)
- Beach outings and grooming services
- Customized care for special needs and senior pets
2.2 Service Area
We currently serve Santa Barbara, Montecito, Carpinteria, Hope Ranch, San Roque, Downtown Santa Barbara, and the Riviera area. Services outside this area may be arranged on a case-by-case basis.
2.3 Service Limitations
- Services are provided only for domesticated pets in good health (with medical conditions managed with veterinary guidance)
- We do not provide veterinary medical care—we only administer medication as instructed
- Emergency veterinary care must be provided by licensed veterinarians
- We do not board pets with contagious illnesses without prior approval

3.1 How to Book

3.2 Meet and Greet
A mandatory Meet and Greet is required before the first service. During this meeting:
- You will meet your assigned pet sitter
- You will review your pet's care instructions, routines, and behavioral notes
- You will discuss home access and security procedures
- You will provide emergency contact information
- You will sign necessary service agreements
This typically lasts 30-45 minutes and may be subject to a small fee.
3.3 Service Confirmation
All service requests must be confirmed by our Company. We will contact you to confirm dates, times, and specific care instructions.
3.4 Authorization
By booking services, you confirm that you are the pet owner or have authorization from the owner to arrange care and to allow Company staff access to your home.
- Payment Terms
4.1 Pricing
Service rates are as follows (subject to change with 30 days' notice):
- Dog Walks & Play: Starting at $42
- Overnights & Boarding: Starting at $140
- Hotel Visits & Travel Ease: Starting at $55
- Beach & Bubbles: Starting at $110
- Fitness & Well-being: Starting at $110
- Weddings & Events: Starting at $42
Additional fees may apply for:
- Medication administration
- Meet and Greet
- Specialized services or extended hours
- Services outside standard service area
4.2 Payment Methods
Payment is accepted through our secure online portal via:
- Credit cards
- Debit cards
- ACH transfers
- Other methods as specified in your account
4.3 Payment Due
Payment is due:
- Before service begins (for new clients)
- At time of invoice (for established clients with account history)
- As specified in your written service agreement
4.4 Late Payments
Late payments may result in:
- Suspension of services
- Late fees (as specified in your invoice)
- Debt collection actions
- Legal proceedings for collection
4.5 Pricing Changes
We reserve the right to change pricing with 30 days' written notice.
- Cancellations and Refunds
5.1 Cancellation Policy
Cancellations must be made through our Precise system or by phone at least 24 hours before scheduled service.
- 24+ hours notice: Full refund or credit toward future services
- Less than 24 hours notice: 50% cancellation fee applies
- No notice or last-minute cancellation: Full service charge applies
5.2 Company-Initiated Cancellations
We may cancel services without penalty if:
- Your pet exhibits dangerous or aggressive behavior toward staff
- Home conditions pose safety risks to our staff or pets
- Payment is overdue
- You violate these Terms and Conditions
- Severe weather makes safe service delivery impossible
5.3 Refund Process
Refunds will be processed within 5-7 business days to the original payment method.
- Liability and Risk Assumption
6.1 Assumption of Risk
You acknowledge that pet care involves inherent risks. By engaging our services, you assume all risks associated with pet care, including but not limited to:
- Injury or illness during activities
- Adverse reactions to grooming, massage, or Reiki services
- Behavioral incidents between pets or with our staff
- Escape or loss of pets (despite reasonable precautions)
6.2 Limitation of Liability
Our Company's liability is limited to the total amount paid for services in the preceding 12 months.
We are not liable for:
- Injuries or illness to pets (except in cases of gross negligence)
- Emotional distress or damages
- Consequential, indirect, or punitive damages
- Loss of enjoyment or companionship
- Property damage (except as covered by our insurance)
6.3 Insurance
Santa Barbara Pet Sitters carries commercial liability insurance. Claims should be reported in writing within 48 hours of the incident.
6.4 Release of Liability
By signing the service agreement and Meet and Greet form, you release Company staff from liability for ordinary care and handling of your pet (except in cases of negligence or willful misconduct).
- Health and Safety Responsibilities
7.1 Pet Health
You are responsible for:
- Providing current vaccination records for your pet
- Disclosing all medical conditions and medications
- Scheduling veterinary care for health issues
- Ensuring your pet is in good health before service dates
We will not provide services for:
- Pets with untreated contagious diseases
- Pets with injuries requiring veterinary care
- Pets in acute distress or medical crisis
7.2 Medication
- You must provide clear, written instructions for medication administration
- You are responsible for ensuring medication is current and properly labeled
- Staff will not administer medications without explicit written authorization
- We are not responsible for missed doses or medication errors if instructions are unclear
7.3 Emergency Care
If your pet requires emergency veterinary care during service:
- We will contact your primary veterinarian immediately
- We will attempt to reach you or your emergency contact
- We may authorize emergency veterinary treatment at your expense if you cannot be reached
- You will be notified of all emergency actions taken
- Home Access and Security
8.1 Access Procedures
We will NOT retain keys on our person except during active service visits. Your home access will be managed through:
- Lockbox with combination
- Electronic keypad entry
- Hidden key location
- Other methods agreed upon in writing
You are responsible for:
- Changing access codes/lockbox combinations after services end
- Providing accurate access instructions
- Notifying us immediately of any security concerns
8.2 Home Inspections
Company staff may inspect your home for:
- Pet safety and comfort
- Hazards or unsafe conditions
- Compliance with care instructions
- Documentation and photo/video purposes
8.3 Confidentiality
Our staff will maintain confidentiality regarding your home, pets, and personal information.
- Photography and Video Use
9.1 Visit Documentation
Pet visits are documented through:
- Written notes in your Precise account
- Photos and short videos shared through your account
- Activity logs and timestamps
9.2 Photo/Video Permissions
By engaging our services, you grant Santa Barbara Pet Sitters permission to:
- Take photos and videos during visits for client records
- Share these with you through your secure Precise account
- Use photos/videos for internal training and quality assurance (with faces obscured)
You have the option to opt out of photo/video documentation; please notify us during your Meet and Greet.
- Behavioral Policies
10.1 Pet Behavior Standards
We reserve the right to discontinue services if:
- Your pet displays aggressive or dangerous behavior
- Your pet poses a safety risk to our staff or other animals
- Your pet has bitten or harmed staff members
- We have concerns about animal welfare in your home
10.2 Staff Conduct
Our staff will:
- Treat all pets with kindness, patience, and respect
- Follow all care instructions provided
- Report any concerns about your pet's health or behavior
- Maintain professional boundaries and confidentiality
- Ownership and Intellectual Property
11.1 Website Content
All content on our Site—including text, images, logos, designs, and original photography—is the property of Santa Barbara Pet Sitters or its licensors. You may not reproduce, modify, or distribute this content without written permission.
11.2 User-Generated Content
By uploading testimonials, reviews, or user content, you grant Santa Barbara Pet Sitters a non-exclusive, royalty-free license to use this content for marketing and promotional purposes.
- Indemnification
You agree to indemnify, defend, and hold harmless Santa Barbara Pet Sitters, its owners, employees, and agents from any claims, losses, damages, or liabilities (including legal fees) arising from:
- Your use of our Services
- Your violation of these Terms and Conditions
- Your breach of applicable laws
- Claims related to your pet's behavior or injuries caused by your pet
- Limitation of Service
We may refuse or limit service to any client for:
- Non-payment of invoices
- Abusive behavior toward staff
- Violation of these Terms and Conditions
- Safety or security concerns
- Any reason within our reasonable discretion
Service suspension will be provided in writing with 5 business days' notice (except in emergency situations).
- Dispute Resolution
14.1 Governing Law
These Terms and Conditions are governed by the laws of the State of California, without regard to conflicts of law principles.
14.2 Jurisdiction
You agree to submit to the exclusive jurisdiction of the courts located in Santa Barbara County, California.
14.3 Informal Resolution
Before pursuing legal action, you agree to attempt good-faith resolution by contacting us directly.
14.4 Legal Fees
The prevailing party in any legal dispute may recover reasonable attorney's fees and court costs.
- Modification of Terms
We reserve the right to modify these Terms and Conditions at any time. Material changes will be posted on our Site with 30 days' notice. Continued use of our Services after changes constitutes acceptance of the modified terms.
- Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
- Entire Agreement
These Terms and Conditions, along with our Privacy Policy and any signed service agreements, constitute the entire agreement between you and Santa Barbara Pet Sitters regarding your use of our Site and Services.
